Mengapa Banyak Warga Masih Tak Memiliki Buku Nikah?

DIDATA NIAS | Dokumen berbentuk Buku Nikah memiliki kepentingan yang sangat signifikan dan sering kali menjadi salah satu prasyarat dalam berjalannya proses keadministrasian kependudukan. Setiap pasangan yang telah menikah namun tidak memiliki Buku Nikah akan berdampak secara luas pada semua urusan keadministrasian kependudukan mereka. Betapa pentingnya dokumen ini ditegaskan oleh fakta bahwa banyak individu yang telah menikah dan memiliki anak, tetapi masih belum memiliki Buku Nikah meski telah mengikuti prosedur pernikahan.

Mengatasi masalah ini, Wakil Ketua Pengadilan Agama Gunungsitoli, M Afif S.HI, menegaskan bahwa Pengadilan Agama Gunungsitoli terus berusaha untuk memainkan peran dalam memfasilitasi warganya dalam mengajukan isbath nikah sesuai dengan anggaran yang tersedia.

Pada acara Pelayanan Terpadu Isbath Buku Nikah, Pengadilan Agama Gunungsitoli telah mengalokasikan dana sebesar Rp. 4.800.000 untuk menangani 36 kasus. Dari total tersebut, 20 kasus ditanggung sepenuhnya oleh pemerintah, sementara 16 kasus lainnya dibiayai dengan bantuan pemerintah pusat sebesar Rp. 4.800.000. Meskipun demikian, tidak semua kasus dapat diselesaikan dalam satu tahun karena keterbatasan anggaran.

Selain itu, terdapat tingkat antusiasme yang tinggi dari masyarakat berkaitan dengan layanan ini, karena banyak masyarakat di wilayah tersebut yang tidak memiliki Buku Nikah karena kendala geografis. Sebagai contoh, seorang advokat dari Tanah Hibala, dimana 99% penduduknya adalah muslim, menyatakan bahwa karena jarak yang cukup jauh, mereka menghadapi kesulitan dalam mencatat administrasi Buku Nikah.

M Afif S. HI juga mengungkapkan harapan untuk mendapatkan tambahan anggaran dari Pemerintah Pusat. Pada awal 2023, Pengadilan Agama Gunungsitoli sudah pernah memohon tambahan anggaran sebesar Rp.80 juta ke Pengadilan Tinggi Agama Medan, namun hingga kini belum terealisasi.

Dengan ini, M Afif S. HI mengharapkan adanya mekanisme yang jelas dalam pengajuan tambahan anggaran dan permohonan tersebut dapat terealisasi untuk mencapai target penyelesaian kasus dan pemberian layanan yang optimal kepada masyarakat.

How important this document is is emphasized by the fact that many individuals are married and have children, but still do not have a Marriage Certificate even though they have followed the marriage procedures.

Addressing this problem, the Deputy Chair of the Gunungsitoli Religious Court, M Afif S.HI, emphasized that the Gunungsitoli Religious Court continues to strive to play a role in facilitating its citizens in applying for marriage isbath in accordance with the available budget.

At the Integrated Marriage Book Isbath Service event, the Gunungsitoli Religious Court allocated funds amounting to Rp. 4,800,000 to handle 36 cases. Of this total, 20 cases were fully covered by the government, while the other 16 cases were funded with central government assistance amounting to IDR. 4,800,000. However, not all cases can be completed in one year due to budget limitations.

Apart from that, there is a high level of enthusiasm from the community regarding this service, because many people in the area do not have a Marriage Book due to geographical constraints. For example, an advocate from Tanah Hibala, where 99% of the population is Muslim, stated that because of the long distance, they faced difficulties in recording the administration of the Marriage Book.

M Afif S. HI also expressed his hope of getting additional budget from the Central Government. In early 2023, the Gunungsitoli Religious Court requested an additional budget of IDR 80 million from the Medan High Religious Court, but until now this has not been realized.

With this, M Afif S. HI hopes that there will be a clear mechanism for submitting additional budgets and that these requests can be realized to achieve the target of resolving cases and providing optimal services to the community.
